1. General Provisions

1.1 Purpose

These Terms of Service (the "Terms") govern your access to and use of the website www.designskin.com (the "Website") and mobile application (the "App") operated by IRUM Designskin Co., Ltd. (the "Company"). By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Services.

1.2 Definitions

The following terms shall have the following meanings in these Terms:

  • "Services" means the Website, the App, and all content, features, and services offered through the Website and the App.

  • "User" means any individual who accesses or uses the Services.

  • "Member" means a User who has registered an account with the Company.

  • "Content" means any text, images, videos, audio files, or other materials posted on the Services by Users or the Company.

1.3 Amendments to the Terms

The Company reserves the right to modify these Terms at any time in its sole discretion. If the Company makes material changes to these Terms, it will post the updated Terms on the Website and update the "Effective Date" at the top of these Terms. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

2. Account Registration

2.1 Eligibility

To register an account with the Company, you must be at least 13 years of age and have the legal capacity to enter into these Terms.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to immediately notify the Company of any unauthorized use of your account or any other breach of security.

3. Use of Services

3.1 Permitted Use

You may use the Services for lawful purposes only. You may not use the Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation.

  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

  • To impersonate or attempt to impersonate the Company, a Company employee, another User, or any other person or entity.

  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by the Company, may harm the Company or Users of the Services or expose them to liability.

3.2 Prohibited Content

You may not post, upload, or transmit any Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

  • Infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.

  • Contains any viruses, worms, defects, Trojan horses, or other items of a destructive nature.

  • Violates the privacy or publicity rights of any third party.

3.3 Monitoring and Enforcement

The Company reserves the right, but has no obligation, to monitor the Services for violations of these Terms and to take any action that the Company deems appropriate, including, but not limited to:

  • Removing any Content that violates these Terms.

  • Suspending or terminating your account.

  • Reporting any activity that the Company suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other third parties.

4. Intellectual Property

4.1 Ownership

The Services and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4.2 Limited License

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

  • You may store files that are automatically cached by your Web browser for display enhancement purposes.

  • You may print or download one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

  • If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

5. Purchases and Payments

5.1 General

By placing an order through the Services, you agree to provide accurate and complete information and authorize the Company to charge your chosen payment method for the total amount of your order, including the price of the product(s), applicable taxes, and shipping fees.

5.2 Payment Methods

The Company accepts the following payment methods:

  • PayPal

  • Credit cards (Visa, Mastercard, American Express, Discover)

  • Country-specific payment methods (e.g., KakaoPay in South Korea)

5.3 Taxes and Duties

  1. For international orders, the recipient is responsible for any import duties, taxes, and fees levied by the destination country.

  2. You will be charged for the estimated duties and taxes at the time of checkout. Once you have paid for these estimated duties and taxes, you will not be charged any further duties and taxes upon delivery. 1

  3. The following are de minimis values for select countries and regions:

    • United States: USD 800 (This exemption does not apply to goods manufactured or shipped from China.) 1

    • Canada: CAD 20 3

    • European Union: EUR 150 4

    • Southeast Asia: Varies by country (Please refer to each country's customs regulations for details.) 5

5.4 Custom-Made Products

Orders for custom-made products require an additional production time of 4-5 business days. Custom-made products are non-returnable.

6. Shipping and Delivery

6.1 Shipping Methods

The Company offers international shipping via FedEx, UPS, Yamato(JP).

6.2 Shipping Fees

  • All international shipping is free of charge.

6.3 Taxes and Duties

1. For international orders, the recipient is responsible for any import duties, taxes, and fees levied by the destination country. 2. You will be charged for the estimated duties and taxes at the time of checkout. Once you have paid for these estimated duties and taxes, you will not be charged any further duties and taxes upon delivery. 3. The following are de minimis values for select countries and regions:  

  • United States: USD 800 (This exemption does not apply to goods manufactured or shipped from China.)¹

  • Canada: CAD 203

  • European Union: EUR 150 4

  • Southeast Asia: Varies by country (Please refer to each country's customs regulations for details.) 5

6.4 Delivery Time

The average delivery time is 5-7 business days. Delivery times may vary depending on the destination country and may be affected by factors outside of the Company's control, such as customs delays or carrier disruptions.

7. Returns and Exchanges

7.1 Return Policy

  1. Custom-made or personalized products are non-refundable and cannot be exchanged.

  2. For other products, you may request a return within 14 days of the delivery date.

  3. To be eligible for a return, the product must be unused, in its original packaging, and with all tags attached.

7.2 Return Process

  1. Contact the Company's customer service team to initiate a return request.

  2. The Company will provide you with a return shipping label and instructions.

  3. You are responsible for the cost of return shipping.

  4. Once the returned product is received and inspected, the Company will issue a refund to your original payment method, less the original shipping cost and any applicable restocking fees.

7.3 Exchange Policy

The Company does not offer exchanges at this time. If you wish to receive a different product, you must return the original product and place a new order.

7.4 Production Time for Custom-Made Products

Orders for custom-made products require an additional production time of 4-5 business days.


8. Disclaimers

8.1 Warranty Disclaimer

THE SERVICES AND ALL CONTENT AND MATERIALS INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8.2 Limitation of Liability

IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Contributions, any use of the Website's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Website.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Korea.

10.2 Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in Seoul, Korea in accordance with the Commercial Arbitration Rules of the Korean Commercial Arbitration Board. The language to be used in the arbitral proceedings shall be English.

11. User Conduct and Responsibilities

11.1 User Conduct

You agree to use the Services in a manner that is lawful, respectful of others, and consistent with these Terms. You may not engage in any activity that disrupts, interferes with, or restricts the use of the Services by others.

11.2 Prohibited Activities

The following activities are strictly prohibited:

  • Using the Services for any illegal or unauthorized purpose.

  • Posting or transmitting any Content that is harmful, offensive, or inappropriate.

  • Interfering with or disrupting the integrity or performance of the Services.

  • Attempting to gain unauthorized access to the Services or any User accounts.

  • Collecting or harvesting any personal information from other Users.

  • Using the Services to distribute spam or unsolicited commercial messages.

12. Termination

12.1 Termination by the Company

The Company may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately.

12.2 Termination by You

You may terminate your account at any time by contacting the Company's customer service team.

12.3 Effect of Termination

Upon termination of your account, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Waiver and Severability

13.1 Waiver

No waiver of by the Company of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

13.2 Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

14. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and IRUM Designskin Co., Ltd. with respect to the Services and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and IRUM Designskin Co., Ltd. with respect to the Services.
